Terms of Use:
1) Indemnifications.
1.1 Indemnifications by customer. Customer agrees to indemnify, defend and hold Cary Skin Care (Corrective Skincare Center, Inc.) , it's owners and employees, harmless from and against any and all losses, claims, demands, damages, liabilities, costs and expenses, including but not limited to reasonable attorney's fees and costs of suit arising out of our Customer's use of services provided to you by Cary Skin Care (Corrective Skincare Center, Inc.) . Such indemnification shall include, but not be limited to, loss of data, claims for libel, slander, infringement of copyright, theft of misappropriation of intellectual property, or unauthorized use of any trademark, trade name, or service mark.
1.2 Indemnification by Cary Skin Care (Corrective Skincare Center, Inc.) Except as otherwise herein provided, Cary Skin Care (Corrective Skincare Center, Inc.) agrees to indemnify, defend and hold Customer harmless from and against any and all losses, claims, demands, damages, liabilities, costs of suit (but excluding consequential damages) arising from Cary Skin Care (Corrective Skincare Center, Inc.) gross negligence in the course of providing service under this agreement.
2) Shipment of Orders:
Cary Skin Care (Corrective Skincare Center, Inc.) supplies products Only under these terms and conditions:
2.1. Customer (Shopper) accepts full liability for the use of all products and services supplied by Cary Skin Care (Corrective Skincare Center, Inc.) . The Customer (Shopper) vows they will only use products under the guidance of their Esthetician.
2.2.. The Customer (Shopper) is completely responsible for the confirmation of their personal importation requirements. Products are not available where prohibited by law.
2.3 The Customer (Shopper) confirms they are of legal age.
2.4. Cary Skin Care (Corrective Skincare Center, Inc.) is not responsible for delays caused by reasons beyond its control, But will provide tracking and assistance in such cases. However the Customer (Shopper) must wait for a period of 4 weeks after the ship date indicated on the dispatch note. In the event of a claim under the registered service, the tracking process can take up to 6 weeks, whereupon a confirmed mailing loss will result in the products being shipped for a second and final time.
2.5. If Cary Skin Care (Corrective Skincare Center, Inc.) has shipped the wrong products, or products have arrived in a damaged condition due to incorrect packaging, the package and products must be returned to Cary Skin Care (Corrective Skincare Center, Inc.) for inspection by contacting Cary Skin Care (Corrective Skincare Center, Inc.) before undertaking any action. If the fault is identified and agreed, Cary Skin Care (Corrective Skincare Center, Inc.) will reship the products a second and final time. Should a refund or part refund be required they are subject to the conditions in section 4.4.
2.6. Cary Skin Care (Corrective Skincare Center, Inc.) does not guarantee delivery, however, each order is provided with a tracking number by usps or other carrier used.
2.7. Cary Skin Care (Corrective Skincare Center, Inc.) Consultation tips are for customer information purposes and, all information is supplied on an educational basis and does not in anyway replace that of a physician's.
2.8. Cary Skin Care (Corrective Skincare Center, Inc.) reserves the right to alter methods of shipments or to refuse orders as it sees fit.
3) Information Acquired:
All information and contents thereof obtained using Cary Skin Care (Corrective Skincare Center, Inc.) and Products and Skin Care tips and advices is the sole responsibility of the customer. Cary Skin Care (Corrective Skincare Center, Inc.), it's owners or employees, will not be held responsible for any damages you or another party suffer as a result of our services and products. Transmission of any material in violation of any Canada and U.S., state or local regulation is strictly prohibited.
4) Canceling:
4.1. If the Customer (Shopper) requests a change in an order
BEFORE PRODUCTS HAVE BEEN SHIPPED or PROCESSED, changes can be made.
4.2.. Customer (Shopper) may not stop or change an order after payment has been processed.
4.3. If (Customer (Shopper) wishes to cancel orders with Cary Skin Care (Corrective Skincare Center, Inc.) before shipment of products, She/He required to give written notice by e-mail. Canceling does not relieve you of the liability for any outstanding funds, which covers up to 10% of cost of package, included within is the restocking fee & processing fee.
